General Terms and Conditions for the sale of products by House of Bluecherry

By placing an order with House of Bluecherry, you agree to the application of these terms and conditions to your order. Please read them carefully before making a purchase.
Section 1: Scope and Provider
(1) Application of Terms
These General Terms and Conditions (GTC) govern the sale of products by House of Bluecherry (the "Provider") to you, the customer, in the version valid at the time of your order.
(2) Conflicting Terms
Any conflicting terms and conditions of the customer are hereby rejected.
(3) Agreement
By placing an order with House of Bluecherry, you agree to the application of these terms and conditions to your order.
(4) Products We Offer
- Real hair wefts, hairpieces and wigs
- Care products and cosmetics
- Accessories
Section 2: Conclusion of Contract
Language
Contracts can only be concluded in German
Age Requirement
Purchaser must be at least 18 years old
(2) Availability
Offers are directed at end customers with billing and delivery addresses worldwide. For bulky items, availability and delivery locations may be limited.
(4) No Binding Offer
The presentation of goods in the online shop does not constitute a legally binding offer. It merely invites the customer to submit a purchase offer.
(6) Contract Formation
The purchase agreement is only concluded upon acceptance by the seller, which occurs at the earlier of: shipment of goods or sending of a shipping confirmation by email.
(8) Order Storage
Your orders are stored after contract conclusion. If you lose your order documents, contact us by email or telephone for a copy.
(9) Electronic Invoices
You agree to receive invoices electronically. Electronic invoices will be made available by email or in your customer account.
Section 3: Prices and Shipping Costs
(1) Price Inclusion
Our prices include applicable statutory value-added tax but do not include shipping costs or surcharges. Shipping surcharges vary depending on delivery method and item nature.
(2) Price Verification
We verify prices when processing your order. If a product is incorrectly priced:
- •Higher than listed: We'll contact you before shipping to confirm
- •Lower than listed: We'll charge the lower amount
(3) Applicable Prices
The prices valid at the time of ordering apply.
Section 4: Delivery and Cancellation
(1) Delivery Address
Unless otherwise agreed, delivery will be made to the customer-specified delivery address. Information regarding availability and delivery is only an estimate unless explicitly stated as binding.
(2) Unavailable Products
If products are unavailable, you'll be informed separately by email or via your customer account. Your statutory rights remain unaffected.
(3) Failed Delivery
If delivery is not possible due to goods not fitting through entrances/doors/staircases, or customer absence despite reasonable notice, the customer bears the costs of unsuccessful delivery.
(4) Delivery Timing
Delivery timing depends on payment method. For advance payment, delivery occurs after payment order is issued. For PayPal, credit card, gift card, direct debit, instant bank transfer, or invoice, delivery occurs after contract conclusion.
(5) Multiple Packages
If your order ships in multiple packages, you may receive separate shipping confirmations. You can cancel orders for individual products free of charge before the corresponding shipping confirmation is sent.
Section 5: Customs
(1) Import Duties and Taxes
When ordering for delivery outside the European Union, you may be subject to import duties and taxes levied once the package reaches its destination.
Important: All customs clearance charges must be borne by you. We have no influence over these charges.
(2) Your Responsibilities
When ordering from House of Bluecherry, you are considered the importer and must comply with all laws and regulations of the country where you receive the products. Cross-border shipments may be subject to opening and inspection by customs authorities.

(3) Cash and Checks Not Accepted
The customer is not permitted to pay by sending cash or checks.
(5) Prepayment Terms
If choosing prepayment, the customer must transfer the invoice amount within five calendar days of receiving the order. Goods will be reserved for five calendar days.
(9) Payment Default
Should the customer default on payment, the supplier reserves the right to claim damages for default.
Section 7: Right of Withdrawal
Your Withdrawal Rights
You have the right to withdraw from this contract within 14 days without giving any reason.

(3) Consequences of Withdrawal
- •We'll reimburse all payments received, including delivery costs (except supplementary costs for non-standard delivery)
- •Reimbursement within 14 days of receiving your withdrawal notice
- •Same payment method used unless you agree otherwise
- •You must return goods within 14 days of communicating withdrawal
- •You bear the direct costs of returning goods
(4) Exceptions to Right of Withdrawal
The right of withdrawal does not apply to:
- ✕Goods unsuitable for return due to health/hygiene reasons if seal removed
- ✕Sealed audio/video recordings or software if seal removed
- ✕Custom-made goods or items tailored to personal needs
- ✕Goods that can spoil quickly or whose expiry date would be exceeded
- ✕Newspapers, periodicals, or magazines (except subscriptions)
Section 8: Warranty Rights
(1) Consumer Warranty
Customers in the European Union have warranty rights for a period of two years from the date of delivery. You can demand repair or replacement of defective products or products not as described.
Your Rights Include:
- Repair or replacement of defective goods
- Refund if repair/replacement not possible within reasonable time
- Reduction of purchase price as alternative
(2) Used Goods
The warranty period for used goods may be shorter than two years.
(4) Non-Consumer Warranty
If the customer is not a consumer, the limitation period is one year (except for damages relating to body/health or intent/gross negligence).
